Terms & Conditions

These Terms and Conditions govern your use of miamaxx.com.au and any purchase you make from it. The site is operated by Dare Too Pty Ltd (ABN 60 156 354 399), trading as Miamaxx. In these terms, “we”, “us” and “our” mean Dare Too Pty Ltd; “you” means the person using the site or placing an order.

By using this site or placing an order you agree to these terms. If you do not agree, do not use the site.

1. Eligibility

This site sells adult products. You must be at least 18 years of age to browse, purchase or use them. By placing an order you confirm you are 18 or over and that you are purchasing for your own use or as a gift for another adult.

2. Orders and acceptance

1. Product listings are an invitation to buy, not an offer. Placing an order is your offer to purchase.
2. A contract is formed only when we send you a dispatch confirmation. An order confirmation email is an acknowledgement that we received the order, not acceptance of it.
3. We may decline or cancel an order — including after payment — if the item is out of stock, if a price or description was published in error, if we suspect fraud, or if we cannot deliver to your address. Where we cancel, we refund you in full.

3. Pricing and payment

• All prices are in Australian dollars and include GST.
• Delivery charges, where they apply, are shown at checkout before you pay.
• Payment is taken at the time of order through our payment provider. We do not store full card numbers.
• Prices can change without notice, but a change never affects an order we have already accepted.
• Pricing errors. If a product is listed at an obviously incorrect price, we may cancel the order and refund you rather than supply at that price. We will tell you before doing so.

4. Delivery

• We deliver within Australia and internationally. Some countries restrict the import of adult products; where a parcel is seized or refused entry by customs, we cannot refund the goods or the freight.
• Import duties, VAT and customs charges on international orders are set by the destination country, are not included in the price paid to us, and are the recipient’s responsibility.
• Delivery timeframes on the Shipping page are estimates provided by the courier, not guarantees.
• Risk in the goods passes to you on delivery. Title passes when payment has cleared in full.
• If an order is returned to us because the address was wrong or the parcel was not collected, we can resend it at your cost, or refund the goods less the original delivery cost.
• All parcels are sent in plain, unbranded packaging. See Shipping & discretion.

5. Changes and cancellations

Contact us as soon as possible if you need to change or cancel an order. We will do what we can, but once an order has been dispatched it cannot be recalled and the returns process below applies instead.

6. Returns, refunds and your consumer rights

Change of mind. For reasons of hygiene and public health, we cannot accept returns of intimate products once the sealed packaging has been opened. Unopened products in original, unmarked packaging may be returned 30 days provided you contact us first for a return authorisation. Return postage for a change of mind is at your cost.

Faulty products. Faults are handled under the warranty and returns process, alongside your consumer guarantee rights. Contact us before returning anything.

7. Warranty

Miamaxx devices carry a 12-month manufacturer warranty from the date of purchase against defects in materials and workmanship. Sleeves and accessories are consumable items and are covered against manufacturing defects only. The warranty does not cover damage from misuse, incompatible lubricants, submersion, unauthorised repair, or ordinary wear. Full terms are on the Warranty page. This warranty is in addition to, and does not limit, your rights under the Australian Consumer Law.

8. Safe use of the products

• Read the instructions supplied with the product before first use.
• Use only water-based lubricant. Silicone lubricant degrades silicone surfaces and will void warranty cover for damage it causes.
• The device is splash-resistant, not waterproof. Do not submerge it and do not use it in a bath or shower.
• Clean the product before and after every use, as set out on the Care page.
• Stop using the product and seek medical advice if you experience pain, irritation or an allergic reaction.
• These products are not medical devices and are not intended to diagnose, treat, cure or prevent any condition. If you have a medical condition, are pregnant, or are recovering from surgery, speak to a health professional before use.

9. Intellectual property

All content on this site — text, images, product photography, video, logos, the Miamaxx name and the site design — is owned by or licensed to Dare Too Pty Ltd and is protected by copyright and trade mark law. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, scrape or use our content for any commercial purpose without our written permission. Approved stockists are supplied with licensed assets through the trade programme.

10. Acceptable use

You must not use this site to do anything unlawful, attempt to gain unauthorised access to it, interfere with its operation, or submit content that is unlawful, defamatory or infringing. Product reviews and submissions may be moderated, edited for length, or removed.

11. Third-party links

The site may link to third-party websites. We do not control them and are not responsible for their content, products or privacy practices.

12. Liability

To the maximum extent permitted by law, and subject always to the Australian Consumer Law:

• The site is provided on an “as is” basis. We do not warrant that it will be uninterrupted or error free.
• We are not liable for indirect or consequential loss, loss of profit, or loss of opportunity.
• Where we are permitted to limit our liability, our liability is limited — at our option — to replacing the goods, supplying equivalent goods, or refunding the price paid.

Nothing in this clause limits any liability that cannot lawfully be limited.

13. Privacy

Personal information is handled in accordance with our Privacy Policy, which forms part of these terms.

14. Changes to these terms

We may amend these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.

15. Governing law

These terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.
